1. Introduction

Welcome to NextStack ("we," "us," or "our"). By accessing or using our website (nextstack.studio) and services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our services.

2. Description of Service

NextStack provides an AI-accelerated web development service. We generate custom landing pages, marketing copy, and assets based on user-provided inputs.

  • Deliverables: A Next.js/React codebase and associated assets (images, copy).
  • Delivery Timeline: We aim to deliver the initial version within 72 hours of payment, but this is an estimate, not a guaranteed deadline.

3. Payments and Refunds

  • Fees: You agree to pay a one-time flat fee of $2,500 USD for the service.
  • No Refunds: Due to the custom nature of the work and the immediate costs incurred by our AI processing and manual review, all sales are final. We do not offer refunds once the project submission has been received and payment has been processed.
  • Payment Processing: Payments are processed securely via Stripe. We do not store your credit card information on our servers.

4. Intellectual Property

  • Your Ownership: Upon full payment, you own the rights to the final code, text, and specific assets delivered to you for your project. You are free to modify, host, and sell the resulting website.
  • Our Ownership: NextStack retains ownership of the underlying "Prompt Packs," methodology, AI workflows, and pre-existing code libraries used to generate your project.
  • AI-Generated Content: You acknowledge that parts of your deliverable are generated by Artificial Intelligence (including Google Gemini and Firecrawl). While we review outputs, you accept that AI content may require human editing for factual accuracy.

5. User Responsibilities

You represent that:

  • You own or have the right to use the website URL and brand assets you submit for scanning.
  • You will not use our service to generate sites for illegal activities, fraud, or hate speech.
  • You are responsible for reviewing the final code and copy for legal compliance (e.g., your own Privacy Policy) before publishing.

6. Disclaimer of Warranties

Our service is provided "AS IS" and "AS AVAILABLE." We disclaim all warranties, express or implied, including accuracy of AI generation, fitness for a particular purpose, or non-infringement. We do not guarantee that the code will be error-free or that the AI will perfectly interpret your brand "vibe."

7. Limitation of Liability

To the maximum extent permitted by law, NextStack's liability shall be limited to the amount you paid for the service ($2,500). We are not liable for any indirect, incidental, or consequential damages (e.g., lost profits, data loss) arising from your use of the delivered website.

8. Governing Law

These Terms are governed by the laws of the State of Arizona, without regard to its conflict of law principles.

  • Project Data: Website URLs, brand assets (logos, pitch decks), and text descriptions you submit via our intake form.
  • Usage Data: Information about how you use our site (via Vercel Analytics).

2. How We Use Your Information

  • To Provide Service: We use your data to generate your landing page and prompt packs.
  • To Process Payments: We use Stripe to handle transactions.
  • To Communicate: We send transaction receipts and project updates via email (using Resend).
  • AI Processing: We send your inputs (URLs, descriptions) to third-party AI models (Google Gemini) and scrapers (Firecrawl) solely for the purpose of generating your project.

3. Data Sharing and Third Parties

We do not sell your data. We share data only with the essential infrastructure providers needed to run our service:

  • Stripe: Payment processing.
  • Google Gemini (Vertex AI): AI text and code generation.
  • Firecrawl: Website scanning and analysis.
  • Neon / AWS: Database and file storage.
  • Resend: Email notifications.

4. Data Retention

We retain your project submission data in our secure database to assist with your build. You may request deletion of your project data at any time by contacting us.

5. Your Rights
